TalkPix Terms of Use

These Terms of Use (“Terms”) govern your access to and use of TalkPix (the “Application”), provided by LCD Media Games (a private limited company registered in the United Kingdom) (“we,” “us,” or “Service Provider”).

By downloading, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

1. Description of Service

TalkPix allows users to upload static portrait images and input text scripts to generate AI-powered talking photos, lip-sync animations, and text-to-speech outputs. The Application utilizes third-party AI models (including Replicate), cloud databases (Firebase), payment gateways (RevenueCat/Apple), and notification providers to operate these features.

2. Eligibility

  • You must be at least 13 years old to use the Application.
  • If you are under the age of majority in your country or region, you may use the Application only with permission from a parent or legal guardian.
  • You must not use the Application if you are prohibited from doing so under applicable law.

3. User Content

“User Content” means any portrait image, photograph, source frame, text prompt, voice script, generated output, or other material you upload, submit, generate, save, share, or otherwise use through the Application.

  • Ownership: You retain full ownership of your User Content. We do not claim ownership of your images, text scripts, or the resulting generated videos.
  • License to Operate: You grant us a limited, worldwide, non-exclusive, royalty-free license to host, upload, transmit, process (via third-party AI models), store, and display your User Content strictly as necessary to operate, generate results, improve, secure, and support the Application.

4. User Responsibility & Consent Requirements

You are solely responsible for all User Content and AI-generated outputs you create, save, share, or publish. By using the Application, you explicitly represent and warrant that:

  • You own or have all required rights, licenses, permissions, and consents for the photos and text scripts you use.
  • Crucial Consent Requirement: You have obtained explicit consent from any real person whose face, likeness, identity, or personal attributes appear in the photos you upload to be animated and synchronized with your written scripts.
  • Your use of the Application will not violate any law, privacy right, publicity right, copyright, defamation law, or other third-party right.
  • You will not use the Application in a deceptive, harmful, abusive, illegal, or non-consensual way.

5. Prohibited Uses (Strictly Enforced)

You may not use the Application to create, upload, generate, distribute, or assist with:

  • Illegal, harmful, abusive, fraudulent, defamatory, or harassing content.
  • Non-consensual animation of another person’s face, likeness, or identity.
  • Harmful, misleading, or deceptive deepfake content (e.g., making it appear as though a real person said something they did not, with the intent to deceive).
  • Impersonation of any real person, public figure, or official in a way that is deceptive, unlawful, or non-consensual.
  • Non-consensual intimate, sexual, nude, or exploitative content.
  • Any sexual, exploitative, abusive, or unsafe content involving minors.
  • Fraud, scams, blackmail, extortion, identity theft, or phishing.
  • Political deception, fake endorsements, election misinformation, or misleading public-interest content where prohibited by law.
  • Bypassing safety filters, automated abuse, scraping, reverse engineering, or interfering with app security.

6. AI-Generated Content & Disclaimers

  • You understand that AI-generated lip-sync and voice outputs may be inaccurate, unrealistic, have visual artifacts, or be unsuitable for your intended use.
  • We do not guarantee that any output will meet your expectations, be legally safe to use, be entirely accurate, or be free from third-party claims.
  • You are entirely responsible for reviewing generated outputs before sharing or publishing them.
  • Labeling and Disclosure: You are responsible for complying with any local or platform-specific laws requiring disclosure, labeling, or restrictions for synthetic media, AI-generated content, or manipulated media when you share TalkPix videos externally.

7. No Unlawful or Unauthorized Use

The Application is provided for lawful, consensual, and creative entertainment use only. To the fullest extent permitted by law, LCD Media Games is not responsible or liable for illegal, unauthorized, deceptive, harmful, or non-consensual use of the Application by users. You agree that any misuse of the Application is your sole responsibility.

8. Enforcement

We reserve the right, where technically and legally possible, to suspend, restrict, or terminate access to the Application if we believe you violated these Terms or used the Application unlawfully. We may also remove, block, preserve, disclose, or report content or account information to authorities if required by law or if necessary to protect users, third parties, or the public.

9. Purchases, Subscriptions, and Credits

  • The Application may offer subscriptions, token/credit packages, consumable purchases, or paid features.
  • Purchases are processed exclusively through the Apple App Store / StoreKit and managed via RevenueCat.
  • Prices, features, credit values, and availability may change from time to time.
  • Refunds are handled entirely by Apple according to Apple’s policies, unless otherwise required by law. We cannot issue direct refunds.
  • You may not attempt to bypass, manipulate, or exploit payment, subscription, or token/credit systems.

10. Third-Party Services

The Application relies on third-party services, including AI processing APIs (Replicate), cloud storage (Firebase), analytics, and payment infrastructure. Your use of the Application is subject to these third parties’ functionality. We are not responsible for third-party outages, processing delays, AI server queues, or third-party data practices.

11. Privacy

Your use of the Application is governed by our Privacy Policy. By using TalkPix, you agree that we may collect, process, store, and share information as described in the Privacy Policy.

12. Service Availability

We may modify, suspend, limit, or discontinue any part of the Application at any time. We do not guarantee that TalkPix will always be available, uninterrupted, or error-free. AI generation may fail, time out, or produce unusable results due to third-party server loads or network issues.

13. Intellectual Property

The Application, including its design, interface, features, code, and TalkPix branding, is owned by or licensed to LCD Media Games. You may not copy, modify, distribute, sell, reverse engineer, decompile, or create derivative works from the Application.

14. Disclaimer of Warranties

The Application is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.

15. Limitation of Liability

To the fullest extent permitted by law, LCD Media Games will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of reputation, or claims arising from your use or misuse of the Application. To the fullest extent permitted by law, our total liability for any claim related to TalkPix will not exceed the amount you paid to use the Application during the three months before the claim arose, or USD $50, whichever is greater.

16. Indemnification

You agree to defend, indemnify, and hold harmless LCD Media Games from and against any claims, damages, losses, liabilities, costs, expenses, or legal fees arising from:

  • Your User Content (photos and text scripts).
  • Your AI-generated outputs.
  • Your use, misuse, or external sharing of the Application’s outputs.
  • Your violation of these Terms or any law or third-party right.
  • Your failure to obtain required rights, permissions, or consents for the photos you animated.

17. Termination

We may suspend or terminate your access to the Application at any time if you violate these Terms, misuse the Application, or create legal risk. You may stop using TalkPix at any time by deleting it from your device. Sections regarding ownership, user responsibility, prohibited use, disclaimers, limitation of liability, and indemnification shall survive termination.

18. Apple App Store Terms

If you downloaded TalkPix from the Apple App Store, you acknowledge that these Terms are between you and LCD Media Games, not Apple. Apple is not responsible for the Application, its content, maintenance, support, warranties, claims, or legal compliance. You must comply with Apple App Store rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Governing Law and Disputes

These Terms are governed by the laws applicable in the United Kingdom (England and Wales), without regard to conflict of law principles, unless mandatory consumer protection laws in your country or region require otherwise.

20. Changes to These Terms

We may update these Terms from time to time. If we update them, we will change the “Last Updated” date above. Continued use of TalkPix after changes means you accept the updated Terms.
