Food Scan AI Terms of Service

These Terms of Use (“Terms”) govern your access to and use of Food Scan AI (the “App”). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1) Eligibility & Basics

  • You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App.
  • No account is required. Some permissions (e.g., Camera/Photos) are optional but may be necessary for certain features.
  • We may update the App and these Terms from time to time (see §13).

2) License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for personal, non-commercial use, and strictly in accordance with these Terms and Apple’s rules.

3) User Content & Your Responsibilities

  • User Content. You may submit content such as photos, videos, titles, calories, and macro entries (“User Content”). You retain your rights to User Content.
  • License to Process. You grant us and our processors a limited license to host, process, and display User Content solely to operate the App (e.g., run AI analysis and show your history).
  • You promise that: (i) you own or have rights to the User Content; (ii) it does not violate any law or third-party rights; (iii) it does not include illegal, harmful, or abusive material; (iv) you will not upload sensitive personal data of others without lawful basis and consent.
  • No prohibited use. Do not: reverse engineer the App (except as permitted by law), interfere with its operation, misuse it to identify individuals without consent, or attempt to access our systems or other users’ data.

4) Health & Nutrition Disclaimer (No Medical Advice)

Food Scan AI provides estimates (e.g., food detection, portions, calories, macros) that may be incomplete or inaccurate and can vary with image quality, lighting, preparation, and other factors. The App does not provide medical, nutrition, or dietetic advice and is not a medical device. Always consult a qualified professional for nutrition or health decisions. You use the App at your own risk.

5) Third-Party Services

To operate the App, we use service providers, including:

  • OpenAI API for image analysis (processing your submitted images to return results).
  • Firebase Analytics & Crashlytics for aggregated usage analytics and diagnostics.
    We also run external marketing (e.g., Google Ads) to promote the App; we do not embed AdMob or similar SDK ads in the App. Your use may be subject to the providers’ terms and policies.

6) Privacy

Our processing of personal data is described in our Privacy Policy (available in-app and on our website). By using the App, you acknowledge the Privacy Policy.

7) Fees & Purchases

The App may be free or offer paid features in the future. If purchases are offered via the Apple App Store, Apple’s payment terms apply. Except as required by law, all transactions are final and handled by Apple; we do not collect or store payment card details.

8) Intellectual Property

The App (including software, UI, logos, text, and other materials) is owned by us or our licensors and is protected by IP laws. Except for the limited license in §2, no rights are granted. Feedback you provide may be used by us without obligation.

9) Termination

We may suspend or terminate your access immediately if you violate these Terms or if we discontinue the App. You may stop using the App at any time. Sections that by their nature should survive (e.g., §§3–6, 8–12) will survive termination.

10) Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS (INCLUDING NUTRITION ESTIMATES) WILL BE ACCURATE, RELIABLE, OR ERROR-FREE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA; OR LOSS RELATED TO HEALTH OR DIET DECISIONS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED USD $50 OR THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS—YOUR RIGHTS MAY VARY.

12) Indemnification

You agree to indemnify and hold harmless LCD Media & Games and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your User Content, or your breach of these Terms.

13) Changes

We may update these Terms. If we make material changes, we will take reasonable steps to notify you (e.g., in-app notice). The updated Terms are effective when posted. Your continued use of the App means you accept the changes.

14) Apple-Specific Terms

If you obtained the App via the Apple App Store, you acknowledge that:

  • These Terms are between you and us, not Apple.
  • Apple has no responsibility for the App or its content.
  • Apple has no obligation to furnish maintenance or support.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.

15) Export & Sanctions

You must comply with applicable export control and sanctions laws. You may not use the App if you are barred from receiving services under the laws of your jurisdiction.

16) Governing Law & Venue

These Terms are governed by the laws of [State/Country, without regard to its conflicts of law rules]. Courts located in [City/State/Country] shall have exclusive jurisdiction. If you are in the EU/UK or another region with mandatory consumer rights, those rights remain unaffected.
