Clearify Terms of Use

These Terms and Conditions (“Terms”) apply to the mobile application Clearify (hereinafter referred to as the “Application”), developed and published by LCD Media Games (the “Service Provider”). The Application is provided as a Free service and is intended for use “AS IS.”

By downloading, accessing, or using the Application, you agree to be bound by these Terms. Please read them carefully.

1. Intellectual Property and Usage Restrictions

All trademarks, copyrights, database rights, and other intellectual property rights associated with the Application and its content remain the exclusive property of the Service Provider.

You are not permitted to:

  • Copy, reproduce, modify, translate, reverse engineer, or decompile any part of the Application
  • Extract or reuse any source code or content
  • Create derivative works based on the Application
  • Use the Application’s trademarks or branding without written permission

2. Modifications and Charges

The Service Provider reserves the right to:

  • Modify or update the Application’s features, design, or content at any time
  • Introduce charges for new or existing services or features (with prior notice within the Application)

You will be clearly informed in advance if any features become paid.

3. Use of Personal Data

The Application processes personal data as described in its Privacy Policy. This may include:

  • Uploaded images (for AI processing)
  • Subscription or purchase-related data
  • Device and usage data for analytics or advertising

You are responsible for:

  • Keeping your device secure and access to the Application protected
  • Not jailbreaking or rooting your device, which may compromise security and break app functionality

4. Uploaded Content and Image Processing

Certain features of the Application allow users to upload images. By using these features:

  • You confirm that you own or have legal rights to any content you upload
  • You grant permission to the Application to process such content using external services, including Replicate API(https://replicate.com)

Uploaded images are processed strictly for the purpose of returning the requested output and are automatically deleted from external servers (Replicate) within one hour. The Service Provider disclaims all liability related to misuse of uploaded content by users.

5. Third-Party Services

The Application integrates with several third-party service providers. By using the Application, you also agree to the terms and conditions of these providers, including:

6. Advertising and Analytics

The Application may display personalized ads and use analytics tools to improve the user experience. Ad networks may collect anonymized usage data and device identifiers (e.g., Advertising ID).

By using the Application, you acknowledge and accept that such services may collect data for relevance and performance optimization. You can opt out of personalized ads via your device settings.

7. Internet and Device Responsibility

Some features of the Application require an active internet connection. The Service Provider is not responsible for:

  • Lack of functionality due to no connection or data plan limits
  • Data charges, roaming costs, or third-party billing while using the Application
  • Device issues, including running out of battery or hardware malfunctions

You are solely responsible for:

  • Keeping your device charged
  • Ensuring stable internet access
  • Covering any data or roaming costs incurred during use

8. Updates and Termination

The Application may be updated from time to time to improve functionality or compatibility. You agree to:

  • Accept all updates when offered
  • Understand that failure to update may result in loss of access or functionality

The Service Provider may also terminate the Application or your access to it at any time without prior notice. Upon termination:

  • All rights granted to you will cease
  • You must stop using and uninstall the Application

9. Limitation of Liability

While the Service Provider strives to provide accurate and reliable services, all data, content, and results within the Application are offered as-is. The Service Provider is not liable for:

  • Indirect or consequential losses arising from reliance on the Application
  • Failures caused by third-party services
  • Loss of data due to user negligence or unauthorized device modification

10. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Turkey (or replace with your country if preferred). Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the courts located in Istanbul, Turkey.

11. Changes to These Terms

We may update these Terms periodically. Updates will be posted on this page and reflected with a revised “Last Updated” date. Your continued use of the Application constitutes acceptance of the updated Terms.
