These Terms of Use (“Terms”) govern your access to and use of ActLike AI (the “Application”), provided by LCD Media Games (“we,” “us,” or “Service Provider”).

By downloading, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

1. Description of Service

ActLike AI allows users to upload, process, and generate AI-powered images, videos, audio/video content, talking portraits, face transformations, identity replacement effects, viral-style content, and related creative outputs.

The Application may use third-party AI, cloud, payment, storage, and notification providers to operate these features.

2. Eligibility

You must be at least 13 years old to use the Application.

If you are under the age of majority in your country or region, you may use the Application only with permission from a parent or legal guardian.

You must not use the Application if you are prohibited from doing so under applicable law.

3. User Content

“User Content” means any image, video, audio, voice recording, face, likeness, prompt, text, file, instruction, or other material you upload, submit, generate, save, share, or otherwise use through the Application.

You retain ownership of your User Content.

You grant us a limited, worldwide, non-exclusive, royalty-free license to host, upload, transmit, reproduce, modify, process, transform, store, and display your User Content only as necessary to operate, improve, secure, support, and provide the Application and its features.

We do not claim ownership of your User Content.

4. User Responsibility

You are solely responsible for all User Content and AI-generated outputs you create, upload, save, publish, share, or distribute.

By using the Application, you represent and warrant that:

  • You own or have all required rights, licenses, permissions, and consents for the content you use.
  • You have obtained consent from any person whose face, voice, likeness, identity, or personal attributes appear in your content where required by law.
  • Your use of the Application will not violate any law, regulation, contract, privacy right, publicity right, copyright, trademark, or other third-party right.
  • You will not use the Application in a deceptive, harmful, abusive, illegal, or non-consensual way.

5. Prohibited Uses

You may not use the Application to create, upload, generate, distribute, or assist with:

  • Illegal, harmful, abusive, fraudulent, defamatory, harassing, or deceptive content.
  • Non-consensual use of another person’s face, voice, likeness, or identity.
  • Harmful, misleading, or deceptive deepfake content.
  • Impersonation of any real person in a way that is deceptive, unlawful, harmful, or non-consensual.
  • Non-consensual intimate, sexual, nude, or exploitative content.
  • Any sexual, exploitative, abusive, or unsafe content involving minors.
  • Threats, bullying, stalking, hate, discrimination, or targeted harassment.
  • Fraud, scams, blackmail, extortion, identity theft, or phishing.
  • Political deception, fake endorsements, election misinformation, or misleading public-interest content where prohibited by law.
  • Content that infringes copyright, trademark, publicity, privacy, or other legal rights.
  • Malware, automated abuse, scraping, reverse engineering, bypassing payments, or interfering with app security.
  • Any use that violates applicable laws, platform rules, App Store rules, or third-party service terms.

6. AI-Generated Content

You understand that AI-generated outputs may be inaccurate, unrealistic, unexpected, offensive, incomplete, or unsuitable for your intended use.

We do not guarantee that any output will meet your expectations, be legally safe to use, be accurate, or be free from third-party claims.

You are responsible for reviewing generated outputs before saving, sharing, publishing, or using them.

You are responsible for complying with any laws requiring disclosure, labeling, consent, or restrictions for synthetic media, AI-generated content, face swaps, deepfakes, or manipulated media.

7. No Unlawful or Unauthorized Use

The Application is provided for lawful, consensual, and creative use only.

To the fullest extent permitted by law, LCD Media Games is not responsible or liable for illegal, unauthorized, deceptive, harmful, or non-consensual use of the Application by users.

You agree that any misuse of the Application is your sole responsibility.

8. Enforcement

We reserve the right, where technically and legally possible, to suspend, restrict, or terminate access to the Application if we believe you violated these Terms or used the Application unlawfully or harmfully.

We may also remove, block, preserve, disclose, or report content or account information if required by law or if necessary to protect users, third parties, our services, or the public.

We are not obligated to monitor all User Content, but we may take action when abuse, violations, or legal risks are detected or reported.

9. Purchases, Subscriptions, and Credits

The Application may offer subscriptions, credits, consumable purchases, or paid features.

Purchases are processed through Apple App Store / StoreKit and may be managed through RevenueCat.

Prices, features, credit values, subscription benefits, and availability may change from time to time.

Refunds are handled by Apple according to Apple’s policies, unless otherwise required by law.

You may not attempt to bypass, manipulate, exploit, or interfere with payment, subscription, credit, or access systems.

10. Third-Party Services

The Application may rely on third-party services, including but not limited to AI processing, cloud storage, analytics, crash reporting, notifications, subscriptions, and payment infrastructure.

Your use of the Application may also be subject to third-party terms and privacy policies.

We are not responsible for third-party services, outages, errors, policies, data practices, or processing delays.

11. Privacy

Your use of the Application is also governed by our Privacy Policy.

By using the Application, you agree that we may collect, use, process, store, and share information as described in the Privacy Policy.

12. Service Availability

We may modify, suspend, limit, discontinue, or replace any part of the Application at any time.

We do not guarantee that the Application will always be available, uninterrupted, secure, error-free, or compatible with every device or region.

AI generation may fail, take longer than expected, or produce unusable results due to third-party services, network issues, moderation systems, processing errors, or technical limitations.

13. Intellectual Property

The Application, including its design, software, branding, interface, features, code, trademarks, and other materials, is owned by or licensed to LCD Media Games.

You may not copy, modify, distribute, sell, reverse engineer, scrape, decompile, or create derivative works from the Application except where permitted by law.

14. Limited License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Application for lawful personal or internal creative purposes, subject to these Terms.

This license does not give you ownership of the Application or any related intellectual property.

15. Disclaimer of Warranties

The Application is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.

We do not warrant that generated outputs will be safe, lawful, accurate, unique, usable, or free from claims by third parties.

16. Limitation of Liability

To the fullest extent permitted by law, LCD Media Games will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of data, loss of profits, loss of reputation, business interruption, or claims arising from your use or misuse of the Application.

To the fullest extent permitted by law, our total liability for any claim related to the Application will not exceed the amount you paid to use the Application during the three months before the claim arose, or USD $50, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Indemnification

You agree to defend, indemnify, and hold harmless LCD Media Games from and against any claims, damages, losses, liabilities, costs, expenses, or legal fees arising from:

  • Your User Content.
  • Your AI-generated outputs.
  • Your use or misuse of the Application.
  • Your violation of these Terms.
  • Your violation of any law or third-party right.
  • Your failure to obtain required rights, permissions, licenses, or consents.

18. Termination

We may suspend or terminate your access to the Application at any time if you violate these Terms, misuse the Application, create legal risk, or use the Application in a harmful or unlawful way.

You may stop using the Application at any time by deleting it from your device.

Sections that by their nature should survive termination will continue to apply, including ownership, user responsibility, prohibited use, disclaimers, limitation of liability, indemnification, and dispute-related provisions.

19. Apple App Store Terms

If you downloaded the Application from the Apple App Store, you acknowledge that these Terms are between you and LCD Media Games, not Apple.

Apple is not responsible for the Application, its content, maintenance, support, warranties, claims, or legal compliance, except as required by applicable law.

You must comply with Apple App Store rules and applicable Apple terms.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you where applicable.

20. Governing Law and Disputes

These Terms are governed by the laws applicable to the Service Provider, without regard to conflict of law principles, unless mandatory consumer protection laws in your country or region require otherwise.

Any disputes will be handled by competent courts with jurisdiction under applicable law.

21. Changes to These Terms

We may update these Terms from time to time.

If we update them, we will change the “Last Updated” date above. Continued use of the Application after changes means you accept the updated Terms.
