This Privacy Policy explains how TalkPix, provided by LCD Media Games (a private limited company registered in the United Kingdom) (“we,” “us,” or “Service Provider”), collects, uses, stores, shares, and protects information when you use the TalkPix mobile application (the “Application”).

By using the Application, you agree to this Privacy Policy. If you do not agree, please do not use the Application.

1. Information We Collect

The Application may collect or process the following types of information:

  • Device Information: Device model, operating system, app version, language, region, and technical identifiers.
  • Usage Information: Session activity, feature interactions, generation status, crash logs, diagnostics, and performance data.
  • Anonymous Account Information: Firebase anonymous user identifiers used to operate uploads, jobs, storage, credits, and history features.
  • Notification Information: Firebase Cloud Messaging tokens, only when notifications are enabled or needed to notify you about generation status.
  • Purchase Information: Subscription or entitlement status, handled through Apple App Store / StoreKit and RevenueCat. (Note: We do not collect your payment card details. Payments and subscriptions are processed entirely by Apple and/or RevenueCat).
  • User Content: Portrait images, source frames, text prompts (voice_script), generation instructions, and the final generated video outputs that you submit or create through the Application.

2. Camera, Photos, and Notification Permissions

The Application may request access to your photo library, camera, and notifications.

  • These permissions are used only for features you explicitly choose to use, such as picking a portrait photo for animation, saving generated videos to your camera roll, or receiving generation status alerts.
  • You can change or revoke these permissions at any time in your device settings.

3. Face Data, Text-to-Speech, and User Content

TalkPix allows users to upload static portrait images and input text to generate “talking photo” video animations with lip-sync capabilities.

  • No Biometric Storage: We do not collect, create, store, or use biometric identifiers, faceprints, facial recognition templates, facial geometry, or biometric authentication data.
  • No Identification: We do not use facial recognition to identify, verify, authenticate, track, or profile any person.
  • Purpose of Processing: Faces, likenesses, and text scripts contained in uploaded content are processed strictly as part of the user-requested AI generation (talking portrait / lip-sync / text-to-speech).

4. How We Use Information

We use collected information only for purposes related to operating and improving the Application, including:

  • Providing core app functionality (animating portraits).
  • Uploading and processing user-selected images and text scripts.
  • Generating AI-based video outputs.
  • Delivering and saving generated results to your local app history.
  • Managing credits, subscriptions, and purchase access.
  • Sending generation status notifications.
  • Preventing abuse, fraud, spam, and unauthorized use.
  • Debugging, crash analysis, security, and performance improvements.
  • Complying with legal obligations.

Strict Privacy Commitments: We do not sell user content. We do not use user content for targeted advertising. We do not track users across third-party apps or websites for advertising purposes. We do notuse uploaded user content to train our own AI models.

5. AI Processing and Third-Party Service Providers

To provide the Application, we utilize trusted third-party service providers:

  • Firebase / Google Services: Authentication, database, storage, cloud functions, app integrity, notifications, diagnostics, and related infrastructure.
  • Replicate: AI image-to-video processing, text-to-speech generation, and lip-sync rendering.
  • RevenueCat: Subscription and in-app purchase entitlement management.
  • Apple App Store / StoreKit: Purchases, subscriptions, refunds, and payment processing.

User content is transmitted to these providers only as necessary to provide the requested feature. These providers process data under their respective privacy policies:

6. Data Retention

  • Temporary Processing: Uploaded source media (portrait images) and prepared processing assets are retained temporarily to complete the generation and are typically deleted automatically after a limited period (up to 3 days).
  • Generated Outputs: Final talking videos may be retained on our secure cloud infrastructure for delivery, replay, history, and user access for up to 90 days.
  • Local History: Local history saved on your device remains until you delete it, uninstall the Application, or clear app data.
  • Operational Data: Job metadata, purchase records, logs, and diagnostic information may be retained as long as reasonably necessary for app operation, legal compliance, accounting, or dispute resolution.

7. User Responsibility, Consent, and Lawful Use

You are solely responsible for the content you upload, animate, generate, save, share, or publish through the Application. By using the Application, you confirm that:

  • You own or have the necessary rights, permissions, and consents for all images, likenesses, and text scripts you upload or use.
  • You have obtained explicit consent from any person whose face, likeness, or identity appears in the content to animate their photo, where required by law.
  • You will not use the Application to violate privacy, publicity, intellectual property, defamation, harassment, fraud, impersonation, or criminal laws.

8. Prohibited Uses

You may not use the Application to create, upload, generate, distribute, or assist with:

  • Illegal, harmful, abusive, fraudulent, misleading, or defamatory content.
  • Non-consensual use or animation of another person’s face, likeness, or identity.
  • Deceptive impersonation, scams, identity fraud, blackmail, or extortion (Deepfakes).
  • Political deception or misleading public-interest content where prohibited by law.
  • Content involving minors in exploitative, abusive, or unsafe contexts.
  • Attempts to bypass safety filters, security, payment, or access controls.

We reserve the right to suspend access, block processing, remove content, or cooperate with legal requests if we believe the Application is being used unlawfully or in violation of this Policy.

9. Limitation of Responsibility for User Misuse

To the fullest extent permitted by applicable law, LCD Media Games is not responsible or liable for:

  • User-uploaded content or user-generated text scripts.
  • Illegal, unauthorized, deceptive, or non-consensual use of the Application by users.
  • A user’s sharing, publishing, or distribution of AI-generated content.
  • Third-party claims arising from user content or user misuse of the Application.

10. Data Sharing

We may share information only in the following situations:

  • With the service providers listed in Section 5 needed to operate the Application.
  • With payment processors to manage purchases.
  • When required by law, court order, subpoena, legal process, or government request.
  • When necessary to protect rights, safety, security, prevent fraud, investigate abuse, or enforce our policies.

11. International Data Processing

Your information may be processed and stored in countries outside your country of residence, including the United States, the United Kingdom, and other locations where our service providers operate. By using the Application, you understand that your information may be transferred to these locations, subject to applicable data protection laws.

12. Security

We use reasonable technical and organizational measures to protect data, including secure transmission methods (HTTPS/TLS) and access-controlled cloud infrastructure. However, no internet-connected system or AI service can be guaranteed to be 100% secure.

13. Children’s Privacy

The Application is not intended for children under 13. We do not knowingly collect personal information from children under 13. Users under the age of majority in their jurisdiction should use the Application only with permission from a parent or legal guardian.

14. Your Privacy Rights (GDPR & International Compliance)

Depending on your location (including the UK and EEA), you may have rights to:

  • Access personal data we hold about you.
  • Request deletion of personal data.
  • Request correction of inaccurate data.
  • Restrict or object to certain processing.
  • Withdraw consent where processing is based on consent.

You can limit or stop data collection by:

  • Uninstalling the Application.
  • Disabling photo library or notification permissions in your device settings.
  • Deleting generated history inside the Application.

We may update this Privacy Policy from time to time. If we make changes, we will update the “Last Updated” date above. Continued use of the Application after changes means you accept the updated Privacy Policy.
